Public Hearing Notice

The Mayor and the City Council of the Town of Amite City will hold a Public Hearing on Tuesday, November 4, 2008 at 7:00 p.m. at the Amite Community Center, 101 W. Chestnut Street, Amite, LA for:

AN ORDINANCE TO ABANDON A PORTION OF EAST PINE STREET,

TOWN OF AMITE CITY

WHEREAS, THERE HAS PREVIOUSLY been dedicated in favor of the public, a street in the Town of Amite City, designated as East Pine Street, with a width of 100 feet;

WHEREAS, Lot 1 of Square 34 of the Town of Amite City is bounded on the North by East Pine Street and on the East by South Myrtle Street;

WHEREAS, a residence was constructed on a portion of Lot 1 of Square 34 nearly 100 years ago;

WHEREAS, it appears that the residence and yard on which it is located extends in the right-of-way of East Pine Street approximately 24.4 feet according to a survey by Barrilleaux & Associates, Inc.;

WHEREAS, only approximately the center 40 feet of the right-of-way is actually used for the street;

WHEREAS, it appears that the construction and maintenance of the residence has been in place for sufficient length of time that it would serve the interest of justice and be in the best interest of all parties concerned, that the Town of Amite City, abandon the South twenty-four feet, three inches (24.4 feet) of the right-of way of East Pine street along the North side of Lot 1 of Square 34 a distance of one hundred forty (140) feet as shown on the survey of Barrilleaux & Associates, Inc., as it is no longer necessary for public use, save any existing utility lines;

BE IT ORDAINED by the Board of Aldermen of the Town of Amite City, that the South twenty-four feet three inches (24.4 feet) of East Pine Street extending along the North line of Lot 1 of Square 34 of the Town of Amite City as shown on survey of Barrilleaux & Associates, Inc. be abandoned as no longer necessary for public use, save any existing utility lines, and that R. E. Goldsby, Mayor, of the Town of Amite City be authorized to execute all documents necessary to accomplish this action.
